ARTICLE 1. SUBJECT

The purpose of these General Terms and Conditions of Sale (“T&C”) is to define the conditions under which Dibotioo makes the Dibotioo Store Manager and Dibotioo Customer App available to subscribers of the www.dibotioo.com website who subscribe to the Platinum Pack and/or Ultimate Pack.

ARTICLE 2. ORDER

2.1. Any order implies the subscriber’s full and unreserved acceptance of the T&Cs. To place an order for the Dibotioo Store Manager application, the subscriber must have a valid credit card or an electronic wallet (PayPal, Mobile Money) as well as a valid email address necessary to receive the order confirmation sent by email.

The subscriber accepts and acknowledges that the validation by him of his online order is proof of his consent to the said order.

2.2. Packs are ordered at the time of subscription on our website www.dibotioo.com. The Products are those offered on the Subscriber Page. Unless otherwise indicated on the Subscriber Page, the Products are available during the time they are displayed on the Subscriber Page.

ARTICLE 3. PRICES AND PAYMENT

3.1. The price of the Dibotioo Pack is expressed in euros including all taxes (TTC), and is the one in force at the date of the order by the subscriber. Any bank charges are indicated at the time of the order and are invoiced at the end of the order in addition to the price of the Pack.

3.2. Pack payment The price of the Dibotioo Pack is payable in cash on the day of the order by credit card. The renewal is payable on the anniversary date of the order by direct debit from the bank account whose details have been provided to Dibotioo by the subscriber when subscribing to the Pack.

3.3. Payment for Products The Price of the Products is payable at the time of the order by credit card, electronic wallet (PayPal, Mobile Money) or direct debit from the bank account whose details have been provided to Dibotioo by the subscriber at the time of his subscription to Dibotioo.

3.4. The invoice shall be communicated to the subscriber on a dematerialised format. All unpaid invoices shall automatically bear interest at the rate of three times the legal interest rate calculated on the amount of the invoice including VAT. Payments without discount.

ARTICLE 4. RETRACTION

4.1. The subscriber has a period of 7 days from the activation of his online shop to retract. In case of withdrawal from the sale of the Dibotioo Pack, the subscription contract to the Dibotioo offer is automatically terminated under the conditions provided in the general subscription conditions of the Dibotioo offers.

To exercise the right of withdrawal, the subscriber must notify his decision to withdraw, before the expiry of the above-mentioned period, by means of an unambiguous statement, for example by using the withdrawal form.

4.2. The subscriber must return the withdrawal letter without undue delay, and in any event no later than 7 days following the communication of his decision to withdraw.

Any cancellation request that is returned incomplete and/or does not comply with these conditions and/or is sent to the wrong address will not be processed as a return and will not be refunded.

ARTICLE 5. DELIVERY AND TRANSFER OF OWNERSHIP AND RISK

5.1. Any failure to pay will result in the immediate closure of the Subscriber’s access to the shop.

ARTICLE 6. INTELLECTUAL PROPERTY RIGHTS

The applications, graphics, trademarks, software packages, software including source codes, and all copyrightable materials incorporated into the Products are owned by Dibotioo or, if applicable, by a third party publisher. Dibotioo and/or the third party publisher grants the subscriber a personal, non-exclusive, non-assignable and non-transferable right to use any copyrightable material incorporated in the Products.

The subscriber agrees not to modify, sell, assign, transfer, reproduce, market adapt, alter, transform, decompile, reverse engineer or create derivative works from any of the copyrightable materials incorporated in the Dibotioo Products. The use of Dibotioo applications is, where applicable, subject to terms and conditions set forth by the publisher of such applications.

ARTICLE 7. PERSONAL DETAILS

The treatment of the subscriber’s personal data collected by Dibotioo is described in the Data Privacy Policy available at https://www.dibotioo.com/informations/politique-de-confidentialite/ 

The subscriber has the right to access, rectify, delete, limit and oppose for legitimate reasons the personal data concerning him/her, as well as the right to portability of his/her personal data via his/her Subscriber Area or by sending a letter and proving his/her identity to Dibotioo or by contacting the Group’s Data Protection Officer at the following email address: support@dibotioo.com.

The subscriber also has the possibility to define directives relating to the conservation, deletion and communication of his personal data after his death, which he can exercise in the same way.

ARTICLE 8. COMPETENCE

The T&Cs are governed by Irish law. Any dispute with professional or business subscribers which is not settled amicably shall be subject to the jurisdiction of the courts in Ireland. For other subscribers the legal rules of jurisdiction apply.
